When is the Mid-Autumn Festival 2024?

Mid-Autumn Festival, also known as the Moon Festival or Children’s Festival, is a traditional holiday celebrated in many Asian countries, including Vietnam. It is typically held on the 15th day of the eighth lunar month. However, the exact date in the Gregorian calendar varies each year.

In 2024, the Moon Festival will fall on Tuesday, September 17, 2024, corresponding to the 15th day of the 8th lunar month, 2024.

Are companies required to give gifts to employees during Mid-Autumn Festival?

No, there is no legal obligation for companies to provide gifts to employees during Mid-Autumn Festival. According to Article 6 of the 2019 Labor Code, gifting falls under voluntary encouragement rather than a mandatory requirement.

However, based on Section 1.4 of Article 6 of the Regulation on Revenue, Expenditure, and Management of Grassroots Trade Union Finance issued under Decision 4290/QĐ-TLĐ in 2022, companies can allocate funds for Moon Festival gifts for employees based on their financial situation. These gifts can be in the form of physical items or other forms depending on the financial capacity of the trade union.

Do employees with young children get a day off during the Mid-Autumn Festival?

According to Article 112 of the 2019 Labor Code, employees are entitled to 11 paid days off for holidays and festivals, including:

  • New Year’s Day: 1 day
  • Lunar New Year: 5 days
  • National Victory Day: 1 day
  • International Labor Day: 1 day
  • National Day: 2 days
  • Hung Kings’ Commemoration Day: 1 day

Mid-Autumn Festival is not included in this list of state-mandated holidays. Therefore, employees with young children will not be granted a day off unless it coincides with a weekend.

However, employees can still apply for paid leave (if they have remaining annual leave days) or unpaid leave (if they have used up their annual leave days) if they wish to take a day off during Moon Festival.
